Introduction and Acceptance of Terms

Welcome to Marble 3D AI, an AI-powered 3D model generation platform featuring a proprietary spatial consistency engine. By accessing or using our service, you agree to be bound by these Terms of Service. If you do not agree with any of these terms, please do not use our service.

Use of the Service

Marble 3D AI provides users with an intelligent platform that transforms images into physics-ready 3D assets using advanced AI technology, including Trellis and Hunyuan3D engines. You agree to use the service in accordance with all applicable local, state, national, and international laws and regulations.

Third-Party AI Services

Marble 3D AI utilizes third-party AI models, including Trellis (by Microsoft Research) and Hunyuan3D (by Tencent), to generate 3D assets based on your inputs.

Important Disclaimer: Marble 3D AI is an independent service provider and is not affiliated with, endorsed by, sponsored by, or specifically approved by Microsoft, Tencent, or any other third-party AI model providers. The mention of these AI models does not imply any partnership, endorsement, or commercial relationship.

We provide a custom interface and value-added services (including our proprietary spatial consistency engine) on top of these underlying AI technologies. All 3D models are generated based on your inputs and provided "as is" without guarantees of accuracy or completeness.

User Accounts and Registration

Account Creation: To access certain features of the service, you need to create an account. You must provide accurate and complete information during the registration process.
Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Age Requirement: You must be at least 13 years old to use this service. Users between 13-18 years old require parental or guardian consent.
User Responsibilities: You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

Content and Intellectual Property Rights

Platform Ownership

All content provided through Marble 3D AI, including but not limited to the spatial consistency engine, dual-model verification technology, designs, code, and documentation, is protected under copyright law. The copyright owner of Marble 3D AI is marble3dai.com.

You acknowledge that you do not own the underlying technology or intellectual property that makes up the Marble 3D AI service, and you agree to respect the intellectual property rights of marble3dai.com and any third parties.

User-Generated Content Ownership

Your Uploads: You retain ownership of any images or content you upload to the service. By uploading content, you grant Marble 3D AI a license to use, process, and store such content solely for the purpose of providing the service to you.
Generated 3D Assets: You retain ownership of the 3D models generated by the service based on your inputs. Marble 3D AI claims no ownership interest in the generated 3D assets.
Platform License: You grant Marble 3D AI a non-exclusive, worldwide, royalty-free license to use anonymized versions of generated assets for service improvement, technical demonstration, and marketing purposes.

Commercial Use Rights

Free Tier Users: 3D assets generated using free credits are for personal, non-commercial use only, including testing, evaluation, and learning purposes.
Paid Subscribers: 3D assets generated with paid credits (Pro plan and above) may be used for commercial projects, including but not limited to games, films, animations, VR/AR applications, and 3D printing.

Credits and Billing

Credit System

The service operates on a credit-based system. Credits are consumed based on the selected mesh density, texture quality, and generation engine.
Credit Validity: Purchased credits are valid for one (1) year from the date of purchase. Unused credits will expire after one year.
Credit Consumption: Credits are deducted at the time of generation. The exact credit cost is displayed before you confirm generation.

Pricing and Payments

All purchases are final and non-refundable. Once credits are purchased or used, they cannot be refunded except as required by applicable law.
Prices are subject to change with notice to users.
You agree to pay all charges associated with your selected plan.
Subscription plans automatically renew unless cancelled at least 24 hours before the renewal date.

Refund Requests

While all purchases are final and non-refundable, we are committed to customer satisfaction. If you experience technical issues that prevent you from accessing or downloading your generated 3D models:

Contact us at support@marble3dai.com within 7 days of purchase
We will respond to your request within 3 business days
If the technical issue is verified and cannot be resolved, we may issue a refund, credit extension, or regenerate the model at our discretion

This refund policy applies only to technical failures and does not cover cases where credits were used successfully to generate 3D models.

Supported Output Formats

Marble 3D AI supports the following export formats:

GLB/GLTF: Primary format for web and real-time applications
Additional formats may be added from time to time

Generated 3D assets include auto-generated physics colliders and optimized geometry for direct import into Unity, Unreal Engine, and other 3D software.

Prohibited Activities and Content

Prohibited Uses

You agree not to engage in any of the following prohibited activities while using Marble 3D AI:

Unauthorized access to or distribution of our proprietary code and technology
Reselling or redistributing Marble 3D AI service as a competitor platform
Interfering with or disrupting the security or performance of the service
Using the service for any illegal or unauthorized purpose
Attempting to bypass any security features or credit limitations
Reverse engineering or attempting to extract the underlying AI models

Prohibited Content

You must not upload content or attempt to generate 3D assets that contain:

Sexually Explicit Content: Pornography, sexually explicit material, or content depicting sexual acts
Violent Content: Graphic violence, gore, or realistic depictions of severe harm
Hate Speech: Content that promotes discrimination, violence, or hatred against protected groups
Illegal Content: Content that violates any applicable law or regulation
Third-Party Intellectual Property: Content that infringes on copyrights, trademarks, or other intellectual property rights

Violations may result in immediate account termination without refund.

AI Generation Disclaimer

Quality Variations: AI-generated 3D models may vary in quality. Marble 3D AI does not guarantee that every generation will meet your expectations or requirements.
Spatial Consistency: While our spatial consistency engine is designed to prevent model collapse, we cannot guarantee 100% structural integrity for all generated assets.
Technical Limitations: The service is provided on an "as is" basis. We make no warranties about the accuracy, reliability, or availability of the service.

Privacy and Data Collection

Marble 3D AI collects the following types of data:

Account Information: Information you provide when creating an account
Usage Details: Data related to your activity on our service
Device Information: Information about the device you use to access our service
Cookies: Data that helps us enhance your experience with our service
Payment and Billing Information: Data necessary to process payments
Uploaded Images: Images are processed for generation and may be temporarily stored. We do not claim ownership of your uploaded images.

Termination

We reserve the right to terminate or suspend your access to the service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the service, us, or third parties.

Upon termination, any unused credits will be forfeited without refund.

Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy, reliability, or availability of the service and disclaim all warranties to the fullest extent permitted by law.

Specifically, we do not warrant that:

The service will be uninterrupted or error-free
Generated 3D models will meet your specific requirements
The service will meet your expectations or be suitable for any particular purpose

Limitation of Liability

To the fullest extent permitted by law, marble3dai.com shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the service, including but not limited to damages for loss of profits, data, or other intangible losses.

Our total liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless marble3dai.com, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

Your use of the service or violation of these Terms
Your uploaded content or violation of third-party rights
Your use of generated 3D assets in any context

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to its conflict of law provisions.

Any disputes arising from these Terms or the service shall be resolved through amicable negotiation. If negotiation fails, the dispute shall be submitted to the competent People's Court in the jurisdiction where marble3dai.com is located.

Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after any changes signifies your acceptance of the new terms.

For material changes, we will make reasonable efforts to provide at least 30 days' notice via email or website announcement.
